JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned AGA accepts notice for respondent Nos. 1 and 2. 2. Petitioner is before this Court seeking for the following reliefs: "Wherefore it is prayed that the Hon'ble Court may be pleased to issue a writ of mandamus or any other appropriate writ or order: a) Direct the Respondent to provide protection to enable the petitioner as per the order dated:14.10.2025 passed in O.S.No.8079/2025 by the XLI Addl. City Civil and Sessions Judge, Bangalore (vide Annexure-D). b) Direct the Respondent Police to register FIR on the complaint dated 01.11.2025 filed by the Petitioner (Annexure-G). - 3 - HC-KAR NC: 2025:KHC:45565 WP No. 33627 of 2025 c) Issue such other reliefs as it deems fit to grant." 3. The grievance of the petitioner is that respondents are not affording police protection to the petitioner in order to implement the orders dated 14.10.2025 passed on IA No.1/2025 in O.S.No.8079/2018 which was passed in pursuance of the earlier order dated 22.03.2025 on IA No.4/2023. 4. By order dated 22.03.2025, the defendants in the suit were restrained from interfering with the plaintiff's peaceful possession of the suit scheduled property till disposal of the suit. By way of the order dated 14.10.2025, the respondent - police were directed to give necessary police protection to the plaintiff to implement the order passed by the court on 22.03.2025. 5. The grievance of the petitioner is that the defendants in the said suit and certain others are not allowing - 4 - HC-KAR NC: 2025:KHC:45565 WP No. 33627 of 2025 the petitioner to enter his property and are obstructing the petitioner. A perusal of the photographs produced would indicate that it is an empty site. 6. If at all, it is for the petitioner to file necessary application for violation of the interim order which has been passed before the trial Court, which the learned counsel for the petitioner submitted has been already filed. 7. It is also open to the petitioner to file such complaints as are necessary which the learned counsel for the petitioner submitted has been filed on 01.11.2025 and the same is not registered by the respondents. 8.
