This writ petition has been filed with the following prayer:- "(A) To issue a writ, order or direction in the nature of mandamus directing the learned court below to decide the Appeal No. 10 of 2008 (Rama Shankar Vs. Chauthi and others) under Section 229-B U.P.Z.A. & L.R. Act, pending before the learned Additional Commissioner Administration-III, Division Gorakhpur within stipulated period fixed by this Hon'ble Court." 2. It is contended by learned counsel for the petitioner that a suit under Section 229-B of the U.P.Z.A. & L.R. Act was decreed. Against which, an appeal was preferred before the Additional Commissioner Administration-III, Division Gorakhpur, which is pending consideration. The sole prayer made is for expeditious disposal of the appeal. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, without calling for counter affidavit, with a direction to the authority concerned to decide the Appeal No. 10 of 2008 (Rama Shankar Vs. Chauthi and others) under Section 229-B U.P.Z.A. & L.R. Act, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4.
