JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “Wherefore, the Petitioner most humbly prays that this Hon'ble Court be pleased to; a) Quash the entire proceedings initiated against the Petitioner in S.C. No. 883/2022 (arising out of Crime No. 52/2021) of Kempegowda Nagar Police Station/Respondent No. 1 for an alleged offence punishable under Section 143, 144, 148, 120(B), 307, 384 read with 149 of IPC and Section 27 of Arms Act pending on the file of Hon'ble LV Additional City Civil and Sessions Judge at Bengaluru (CCH-56); b) Pass any other order or direction/s as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice.” 2. Learned counsel for the petitioner – accused No.11 and learned counsel for 2nd respondent – complainant have filed a Joint Compromise Petition duly filed along with Joint Affidavit duly - 3 - HC-KAR NC: 2025:KHC:27717 CRL.P No. 10550 of 2025 signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioner – accused No.11, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Compromise Petition duly filed along with Joint Affidavit, which reads as under:- “JOINT COMPROMISE PETITION It is respectfully submitted as follows: That the Petitioner herein is Accused No. 11 in S.C. NO. 883/2022 pending on the file Hon'ble LV Additional City Civil and Sessions Judge at Bengaluru (CCH-56) for an alleged offence punishable under Section 143, 144, 148, 120(B), 307, 384 read with 149 of IPC and Section 27 of Arms Act. That the Petitioner in the above case and the Respondent NO. 2/defacto complainant compromise and settle the dispute between them in the intervention of elders and well wishers. Accordingly the respondent No. 2 do not wish to continue with the above case as against the Petitioner in the above criminal petition as well as in S.C. No. 883/2022 pending on the file Hon'ble LV Additional City Civil and Sessions Judge at Bengaluru (CCH-56). Wherefore, it is prayed that this Hon'ble Court may be pleased to permit the above named Petitioner and the respondent No. 2/ Defacto complainant to compound and compromise the above case, in the interest of justice.” - 4 - HC-KAR NC: 2025:KHC:27717 CRL.P No. 10550 of 2025 “JOINT AFFIDAVIT We, (a) Dilip Raj @ Dilipa @ Huchappa, S/o. Late. K. Raju, aged about 34 years, residing at No. 4, 2nd Cross, Devi Nagar, Lottegollahalli, Bhadrappa Layout, Hebbal, Bengaluru-560 024 and (b) Deepak @ Kulla Deepak, S/o. Ramanna, aged about 41 years, residing at No. 120, 2nd Cross, Nanjappa Block, B.T. Layout, Near Bhajane Mandira, Bengaluru-560 019do hereby solemnly affirm and state on oath as follows: 1. We submit that, we are the Petitioner and Respondent case. We know the facts and No. 2 in the above circumstances of the case. Accordingly we are swearing this joint affidavit accordingly. 2. We submit that, based on the complaint filed the Respondent No. 2 a criminal case has been registered against the Petitioner in S.C. No. 882/2022(arising out of Crime No. 52/2021) of Kempegowda Nagar Police Station/Respondent No. 1 for an alleged offence punishable under Section 143, 144, 148, 120(B), 307, 384 read with 149 of IPC and Section 27 of Arms Act pending on the file of Hon'ble LV Additional City Civil and Sessions Judge at Bengaluru (CCH-56). Now the said case is pending for , consideration. 3. We submit that, on the intervention of friends and well wishers the matter has been settled between us, Accordingly the respondent No. 2 do not wish to continue with the above case as against the Petitioner only in the above criminal petition as well as in S.C. No. 883/2022 - 5 - HC-KAR NC: 2025:KHC:27717 CRL.P No. 10550 of 2025 pending on the file of Hon'ble LV Additional City Civil and Sessions Judge at Bengaluru (CCH-56). In view of the settlement, we pray for quashing of the proceedings against the Petitioner in in S.C. No. 883/2022 pending on the file of Hon'ble LV Additional City Civil and Sessions Judge at Bengaluru (CCH-56), in the interest of justice. We, the deponents above named, do hereby verify that this is our names and signatures and the contents of this affidavit are true and correct to the best of our knowledge, information and belief.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Compromise Petition duly filed along with Joint Affidavit dated 22.07.2025. (ii) The proceedings in S.C.No.883/2022 (arising out of Crime No.52/2021 of 1st respondent – Police) registered for the offences punishable under Sections 143, 144, 148, 120(B), 307, 384 read with Section 149 of IPC and Section 27 of Arms - 6 - HC-KAR NC: 2025:KHC:27717 CRL.P No. 10550 of 2025 Act pending on the file of LV Additional City Civil and Sessions Judge, Bengaluru, insofar as the petitioner is concerned are hereby quashed.
