This writ petition has been filed with the following prayers: "To issue a writ, order or direction in the nature of mandamus commanding and directing the Respondent concerned i.e. Respondent No.2 to entertain by way of allotting the Case Number and decide the Appeal filed under Section 35(2) of U.P. Revenue Code, 2006 (Parmeshwari and another Vs Smt. Vibha) dated 4.7.2025; ii. To issue a writ, order or direction in the nature of mandamus commanding and directing the Respondent No.2 to decide the Stay Application dated 4.7.2025 filed with the Appeal [Parmeshwari & another Vs Smt. Vibha] under Section 35(2) of U.P. Revenue Code, 2006." 2. From perusal of the prayer made in the writ petition, it appears that proceedings under Section 35(2) of the U.P. Revenue Code, 2006 are pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending or calling for a counter affidavit, the writ petition is disposed of requiring the respondent no.2 to take a final decision on the said appeal within a period of two months from the date of production of a certified copy of this order. 4. It is made clear that the Court has not adjudicated the matter on merits.
