Neutral Citation No. - 2025:AHC:143905 Court No. - 5 Case :- WRIT - A No. - 12006 of 2025 Petitioner :- Mamta Bharti Respondent :- Uttar Pradesh Cooperative Bank Ltd., And 3 Others Counsel for Petitioner :- Anil Kumar Tiwari,Pushpendra Kumar Mishra Counsel for Respondent :- Ashok Kumar Lal Hon'ble Saurabh Shyam Shamshery,J. 1.Heard Sri Pushpendra Kumar Mishra, learned counsel for the petitioner and Sri Ashok Kumar Lal, learned counsel for the respondents. 2. Petitioner, wife of a deceased employee is claiming compassionate appointment, however, her claim was rejected by the impugned order since her mother-in-law (mother of deceased) has given an affidavit that petitioner was not living along with her and she had no cordial relationship with her deceased husband also, therefore, she may not be granted compassionate appointment. 3. At the first blush, occasion to reject prayer to grant compassionate appointment to the petitioner does not appeal to this Court. However, learned counsel for the petitioner has shown some documents which includes that petitioner herself has lodged an F.I.R. in the year 2009 against her husband and his family members. However, outcome of it not on record and this fact has also not been disclosed in the present writ petition as well as she has attempted suicide also, therefore, reason to reject prayer for compassionate appointment has substance. 4. Learned counsel for the petitioner on basis of limited instructions submits that later on a compromise was entered into between the parties, however, there is nothing on record to support this submission. 5. In the aforesaid circumstances, there is no illegality in the impugned order. However, in case, petitioner still makes an attempt to have cordial relationship with her in-laws and in case they grant NOC with a condition that petitioner will take care of them, her fresh claim for compassionate appointment if filed within 6 months from today may be considered by the respondents within a short period in accordance with law taking note of aspect of delay also since petitioner's husband had died in harness on 9.7.2019. 6. With aforesaid observations/direction, this writ petition is disposed of. Order Date :- 21.8.2025 SB Digitally signed by :- SANDEEP BHATTACHARYA High Court of Judicature at Allahabad
