1. The petitioners have filed this petition seeking the following relief(s):-
“10.1 That, to call for the entire records pertaining to the petitioner's case for the kind perusal of the Hon'ble Court. 10.2 That, the Hon'ble Court may kindly be pleased to set aside impugned order dated 13.08.2019 passed by respondent no.
4 (ANNEXURE P/1) and further be pleased to direct the respondents for using plot no. B-59 and B-60 of respondent no. 7, for residential use only and stop all commercial activity with immediate effect and demolish the illegal part of construction made upon plot no. B-59 & B-60 of respondent no. 7, in the interest of justice. 10.3 That, the Hon'ble Court may kindly be pleased to grant any other relief, as if may deem fit and appropriate. 10.4 Cost of the petition may also be given.”
2. Learned counsel appearing for the petitioners, would submit that respondent No.7 has raised construction in violation of sanctioned map at Khamardih, Raipur. 3. On the other hand, learned counsels appearing for the respondents would oppose the submissions made by Mr. Sahu. They would submit that an application for regularization of illegal construction was moved before the respondent authorities and it has already been regularized
3 and certificate has been issued by the District Regularization Committee, Nagar Tatha Gram Nivesh Zila Raipur on 08.12.2023 and the petitioners have not challenged said order. 4. I have heard learned counsel appearing for the parties and perused the documents placed on the record. 5. Taking into consideration the fact that the order of regularization has already been passed in favour of respondent No.7 and the certificate has been issued by the competent authority on 08.12.2023, thus, nothing survives for adjudication in this matter. 6. Accordingly, the present petition is dismissed. However, the petitioners would be at liberty to revive their prayer, if new cause of action arises in near future. Sd/-
