ORAL ORDER
Learned counsel Sri.A.Ravi Shankar has filed Vakalat for respondent No.2. The same is taken on record. 2. Petitioners are seeking to quash the FIR and complaint in Crime No.0180/2025 of Electronic City Police Station, Bengaluru city, registered for the offence punishable under Section 85, 352, read with Section 3(5) of BNS and Section 4 of Dowry Prohibition Act. 3. Respondent No.2 is the defacto complainant. On her complaint, aforementioned case was registered against the petitioners. 4. A compromise petition is filed before this Court under Section 359 read with Section 528 of BNSS 2023 to permit the parties to compound the offence and quash the proceedings. 4. The compromise petition is accompanied with the affidavits of the petitioners and respondent No.2 /

defacto complainant. Paragraph No.2 of the compromise petition is extracted hereunder:
"2. It is submitted that the Petitioners and Respondent No.2 in the above criminal petition have their intersay misunderstanding and with the intervention and advices of well-wishers and elderly members of their respective families. Further the Petitioner No. 1 and the Respondent no. 02 have agreed to settle the case in M.C No. 73/2025 thereby filing memorandum of settlement with the condition that both the parties have agreed to withdraw all the cases filed against each other. The parties have settled their dispute amicably and they no longer intend to pursue the proceedings challenged in the above criminal petition. The Respondent No.2 who is the de-facto complainant is present before this Hon'ble Court and has filed an affidavit in support of this compromise petition, request and gives her no objection for quashing the entire proceedings in Crime No.0180/2025 for the alleged offence punishable u/s 85, 352 r/w 3(5) of BNS, and section 4 of Dowry Prohibition Act registered by electronic city P.S,

pending on the file of Learned CJM Bangalore rural district, Bengaluru transferred from DK women P.S in Crime No. 0019/2025 as prayed for in order to secure the ends of justice and to prevent the abuse of process of law.”
5. Petitioners and respondent No.2 are present before the Court. They are identified by the learned counsel appearing for them.
Respondent No.2 submits that the dispute has been resolved and in view of the settlement, she is not interested in proceeding with the matter and she has no objection for quashing the proceedings. 6. It is also submitted that a memorandum of settlement is already filed in M.C. No.73/2025, before the court of the Principal Senior Civil Judge and ACJM, Puttur DK and a joint petition for divorce by mutual consent is filed under Section 13B of the Hindu Marriage Act 1955. 8. The Hon’ble Apex Court in Narinder Singh and Others V. State of Punjab and Another reported in

(2014) 6 SCC 466 has held that when the parties have reached the settlement and on that basis, petition for quashing the criminal proceedings is filed, the guiding factor in such cases would be:(i) to secure the ends of justice; or (ii) to prevent abuse of the process of any Court. It is further held that the criminal cases having overwhelmingly and predominantly civil character, particularly those arising out of commercial transactions or arising out of matrimonial relationship or family disputes should be quashed when the parties have resolved their entire disputes among themselves. 9. In B.S.Joshi and others V. State of Haryana and another reported in (2003) 4 SCC 675, the Hon’ble Supreme Court has upheld the powers of the High Court under Section 482 of the code to quash criminal proceedings, where dispute is of a private nature and the compromise is entered into between the parties. 10. The matter arises out of a matrimonial dispute, wherein the parties have settled the dispute. Hence, no

purpose will be served in continuing the proceedings. To secure the ends of justice, it is just and proper to give a quietus to the entire dispute. Accordingly, the following:
ORDER i. The compromise petition is allowed. Consequently, the petition is allowed. ii. The entire proceedings arising out of FIR registered at Electronic City Police Station, Bengaluru City in Crime No.180/2025 stands quashed. Pending I.A.s stands disposed of.
