JUSTICE V SRISHANANDA ORAL ORDER Wife has filed this petition under Section 24 CPC with the following prayer: "WHEREFORE, in view of the above said facts and circumstances it is therefore most respectfully prayed that this Hon'ble Court be pleased to: "(i) transfer the matrimonial case bearing M.C.No.15/2022 titled as Praveen Kumar versus Jenifer J., pending before the Court of the Senior Civil Judge, Bhalki to the Court of the Principal Judge, Family Court, Bangalore, Karnataka." 2. Facts of the case are as under: Matrimonial relationship between the parties strained and therefore respondent-husband filed a petition under Section 27 of the Special Marriage Act for dissolution of the marriage which is now pending on the file of Civil Judge Senior Division, Bhalki, Bidar District, in M.C.No.15/2022. Petitioner-wife contends that she is residing at United Kingdom and unable to attend the case before the - 3 - HC-KAR NC: 2025:KHC:47004 CP No. 170 of 2025 Court at Bhalki and therefore she has given the power of attorney to her father who is at Bengaluru and seeking transfer of the case to Bengaluru. In the first place, the matter cannot be effectively conducted by a power of attorney holder of the wife in Bengaluru Court. In a matrimonial proceedings, parties are required to appear in person. Taking note of the fact that the respondent's wife is residing in United Kingdom, she can effectively participate in the matrimonial proceedings at Bhalki through video conferencing facility. If the petitioner files an application before the Court at Bhalki, the learned Judge shall permit the petitioner to appear through video conferencing facility.
