(Oral) The prayer in the present petition under Section 528 BNSS, 2023 is for quashing of the impugned order dated 11.09.2025 (Annexure P- 4) passed by the Judicial Magistrate Ist Class, Yamuna Nagar vide which the complaint bearing No.COM/159/2025 (Annexure P-3) moved by the petitioner with prayer to send the same under Section 175(3) BNS to the SHO of Police Station City Yamuna Nagar for registration of an FIR under Sections 61(2), 316(2), 318(4), 338, 340(2) and 351(2) of BNS, 2023, has been dismissed and no opportunity has been granted to treat the case as a complaint case. 2. The learned counsel for the petitioner contends that the petitioner would be satisfied in case directions are issued to the Trial Court permitting the petitioner/complainant to file a private complaint. 3. In view of the prayer made, it is clarified that the impugned order dated 11.09.2025 (Annexure P-4) shall not preclude the petitioner/complaint to file a private complaint in accordance with law. 7.
