Heard the parties.
The petitioner has been made accused in connection with Chatra Sadar P.S. Case No. 340 of 2024, for the offence registered under Sections 21, 22, 27 & 29 of N.D.P.S. Act and Sections 25(1-B)(a)/26 of the Arms Act, pending in the court of Sri Shambhu Lal Shaw, learned Sessions Judge- cum-Special Judge (NDPS), Chatra.
On 01.11.2024 at about 10:30 p.m., petitioner was apprehended by Chatra Sadar police. On search, 227 grams of brown sugar and a loaded country made pistol were recovered from his possession.
It was submitted that the quantum of seized contraband comes within the purview of intermediary quantity. It was further submitted that petitioner has got no criminal antecedent.
Attention has been drawn towards an application filed by the father of the petitioner before the Superintendent of Police, Chatra that the petitioner has been falsely implicated in this case due to previous rivalry with a Police Officer of Chatra Police Station.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Shambhu Lal Shaw, learned Sessions Judge-cum-Special Judge (NDPS), Chatra, in connection with Chatra Sadar P.S. Case No. 340 of 2024.
