Hussain, learned counsel for the petitioner and Mr. K. K. Parashar, learned Additional Public Prosecutor, Assam. 2. Apprehending their arrest, the petitioners, namely, (1) Abjalur Rahman, son of Abbash Ali and (2) Abdul Matin, son of Abbash Ali, both residents of Village-Daulatpur, Police Station-Bihpuria, District-Lakhimpur have filed this application under Section 482 BNSS, 2023 seeking pre-arrest bail in Moirabari P.S. Case No. 502/2021 under Section 370/387 IPC corresponding to Sessions (Special) Case No. 02/2024 under Sections 370/387/34 IPC. 3. On instructions of the petitioners, Mr. M. K. Hussain, learned counsel prays for withdrawal of this pre-arrest bail application, with liberty to filed afresh, to which Mr. K. K. Parashar, learned Additional Public Prosecutor, Assam has no objection. 4. Prayer is allowed. 5. Accordingly, this pre-arrest bail application stands dismissed on withdrawal. 6.
