ORDER IS PASSED.
CONCILIATION ORDER
This RFA is filed by the appellant/plaintiff praying to set aside the
judgment and decree dated 08.08.2007 passed in O.S.No.1686/2001 by the III Additional City Civil Judge (CCH-25), Bengaluru City. 2. Ms.Anjana A.V., learned counsel for Smt.Rakshitha D.J., learned counsel for the appellant and Sri.S.C.Mahadeva Murthy, learned counsel for the respondents are present. 3
3. After detailed deliberation, the matter has been settled. A joint memo to that effect has been filed, which reads as under:
"The Appellant and Respondent humbly submits as follows:
1. The present appeal is filed for setting aside the Judgment and Decree dated 08.08.2007 in O.S. No.1686/2001, passed by the III Additional City Civil Judge (CCH-25) in Bangalore, which dismissed suit and along with other reliefs. It is submitted that, the OS No.1686/2001 filed in respect of site No.15 formed in Sy.86/1 of Hosakerehalli Village. 2. I submit that on 26.11.2025 when the matter was listed for the hearing, both parties came to an amicable settlement terms that the Respondent herein is agreed to pay the sum of Rs.12,00,000/- TWELVE Lakh only) to the Appellant herein. The said 12 lakh rupees is to be paid in three instalments by the Respondent, i.e., 5 lakh rupees on 13.12.2025 by way of DD, another 3 ½ (3.50 lakh) lakh in on or before 30th January 2026, and the remaining 3.5 lakh rupees on or before 30th of April 2026. It is further agreed by both parties that after receiving full amount as agreed, the Appellant herein will execute the registered SALE deed in favour of Respondent herein. 3. It is submitted that both parties have agreed to settle as per the above terms and further, both parties submitted that if the Respondent failed to pay the amount in time, Appellant has reserved liberty to revoke the settlement and reopen and restore the above appeal and contest the matter. WHEREFORE, I respectfully pray that this Hon'ble Court be pleased to take the joint memo in the interest of justice."
4. As per the joint memo, both parties have amicably settled the matter between themselves, wherein the respondents have agreed to pay a sum
4 of Rs.12,00,000/- to the appellant herein. Today, the respondents have paid a sum of Rs.5,00,000/- to the appellant. The appellant acknowledges the receipt of the same. The remaining amount shall be paid as agreed in the joint memo. 5.
In view of the above, the appeal is disposed of as settled before the Lok Adalat in terms of the joint memo. Registry shall draw the decree accordingly. Sd/- JUDGE
