ORAL ORDER
1. The petitioner is Chief Officer in the Health Department of the State of Karnataka. The son of the complainant/respondent No.2 is working as a Health Officer in the same Department. The petitioner is a superior officer to the son of the second respondent. It is seen from the records that the petitioner had initiated disciplinary proceedings against the son of the second respondent - complainant. Subsequently, thereafter, the second respondent - complainant lodged a complaint with the first respondent that the petitioner is harassing his son and an FIR has been registered against the petitioner under Sections 504 and 506 of the IPC, 1860 and Sections 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.
2. The case of the petitioner is that the complaint has been lodged because the petitioner initiated action against

the son of the second respondent, who was not working properly.
3. The records reveal that the petitioner had issued notices and also recommended to the higher authorities to take action against the son of the second respondent - complainant for not working properly.
4. Under the circumstances, the complaint against the petitioner has to be construed as a reaction to the disciplinary action initiated by the petitioner against the son of the second respondent.
5. It is obvious that a complaint has been lodged only with an intention to harass the petitioner.
6. For the aforementioned reasons, the petition is allowed. The FIR registered in Crime No.90/2022 pending on the file of the II Additional District and Sessions Judge, Kolar, stands quashed.
