1. Heard Ms. A. Das, the learned counsel for the applicants. Also heard Ms. S. Todi, the learned counsel for the respondents. 2. This application under Section 5 of the Limitation Act, 1963 has been preferred by the applicants for condoning the delay of 3158 days in filing the application for setting aside of abatement of the appeal on the death of the sole appellant Rama Ranjan Chanda. 3. The learned counsel for the applicants has submitted that the present applicants, who are the legal heirs of the deceased appellant of RSA No. 255/2010, came to know about the pendency of the connected regular second appeal only in the year 2025. 4. It is also submitted that the engaged counsel for the deceased
Page No.# 5/5 appellant also came to know about the death of the appellant when submission to that effect was made by the counsel for the respondent before this Court. 5. The learned counsel for the applicants has submitted that the applicants have stated the cause for delay in paragraph No. 8 of the instant application. 6. On the other hand, considering the statement made in the petition, the learned counsel for the respondents has not objected to the prayer for condoning the delay. 7. After considering the submissions made by the learned counsel for both the parties, as well as the grounds stated in the condonation of delay application by the applicants, this Court is of the considered opinion that the delay of 3158 days has been sufficiently explained and therefore, the same is hereby condoned. 8.
