This is an application U/s 482 Cr.P.C. filed for quashing the entire proceedings of Special Complaint No 15 of 2015 (State vs. Gulshan) under Sections 26/52, 58,59 of Food Safety and Standards Act, 2006, P.S. Kulpahad, District Mahoba pending in the court of Additional Sessions Judge, court no.1 Banda as well as summoning order dated 28.05.2015 passed by Additional Sessions Judge, Banda. 3. Learned counsel for the applicant submitted that non bailable warrant has been issued against the applicant and he submits that he had no knowledge about the factum of issuance of warrant. It is further submitted that time be granted to prefer an application for recalling of the said order and till then protection be accorded. 4. Learned AGA submitted that it is always open to submit an application for recalling of the order. 5. Considering the submissions so made across the bar, the present application is finally disposed of directing the applicant to file a recall application by 16.05.2025 and on the said application so preferred, the court below shall decide the same strictly with most expedition. If any application so preferred by the applicant for recall, it is directed that till the disposal of the said application, no coercive action shall be taken against the applicant.
