Neutral Citation No. - 2025:AHC:146050 Court No. - 87 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 28507 of 2025 Applicant :- Seraj Ansari Opposite Party :- State of U.P. Counsel for Applicant :- Kedar Nath Mishra Counsel for Opposite Party :- G.A. Hon'ble Santosh Rai,J. 1. Heard learned counsel for the applicant; learned AGA for the State and perused the material placed on record. 2. The instant bail application has been filed on behalf of the applicant, Seraj Ansari with a prayer to release him on bail in Case Crime No.104 of 2025, under Sections 191(2), 115(2), 352, 126(2), 281, 109 B.N.S., Police Station Salempur, District- Deoria during pendency of trial. 3. Learned counsel for the applicant has submitted that the alleged injured/informant were medically examined and simple injuries are found. He further submits that the other co-accused, namely, Dhruv Kumar Srivastava, who has also been assigned the same role as to the applicant, has already been enlarged on bail by co- ordinate Bench of this Court on 01.08.2025 in Criminal Misc. Bail Application No.26480 of 2025 and the present applicant is also entitled to get the benefit of parity of the bail order of co-accused. The applicant has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since 27.04.2025. It is further argued that there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. 4. Per contra, learned AGA has vehemently opposed the the prayer for bail. 5. After perusing the record in the light of submission advanced by learned counsel for applicant and learned AGA and considering all above facts and circumstances, the nature of accusations, severity of the punishment and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case, but without commenting on merit of case, a case for bail is made out. 6. Accordingly, the bail application is allowed. 7. Let the accused-applicant, Seraj Ansari involved in above mentioned case crime number be released on bail, on his executing a personal bond and two reliable sureties each, in the like amount to the satisfaction of the court concerned, subject to the following conditions: i. In the event of breach of any of the aforesaid conditions, the court below will be at liberty to proceed to cancel his bail. 9.
