A case has been registered against the Petitioner herein and others for the offences punishable under Sect-Ions 379 IPC and section 20(1)(d)(i)(a) read with 20(1)(c) ii, iii, iv, x, 36(a) read with 32A of the A.P. Forest (Amendment) Act, 2016. 3. Brief facts of the case are that, on 12.01.2023 at about 6.00 am, at lragalappa swamy Temple area, Chelluru Forest Beat, Yerpedu Mandal, in which Al was arrested and 16 red sander roots were seized from his possession. During the /a *_ }f-92< \,.---` s- course of investigation, Al confessed about the involvement of the other accused. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that the Petitioner iS nO Way concerned With the Offence alleged and no Property Was Seized from the possession Of the Petitioner, Only basing on the confessional statement of A1, the petitioner herein is arrayed as accused in the present crime. The petitioner has been in judicial custody from 31.01.2025. Learned Assistant Public Prosecutor submits that preliminary charge sheet has been filed and the pet-ltioner herein has no previous crime record| It is submitted by the learned counsel for the petitioner that the petitioner has permanent abode and there is no possibility of his fleeing away from the Jurisdiction of the Court. 6. In view of the facts and circumstances of the case, since the petitioner herein is arrayed as accused basing on the confessional statement of A1, this Court is inclined to grant bail to the petitioner herein/A5, on the following conditions. i. The petitioner/A5 shall be released on executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of .RI -_-_-- the learned Judicial Magistrate of First aass for Tr,-al of cases relating to Red Sander smuggling, TirupatI'. ii. on release, the petitl-oner sha" appear before the station House officer concerned, once I-n a fortnight I-.e., on lst and 15th of every month between 10.00 AM and o1.00 PM., for a Period Of three (3) months. iji.
