Counsel for Applicant :- Ved Mani Sharma Counsel for Opposite Party :- G.A. Hon'ble Samit Gopal,J. 1. List revised. 2. Sri Ved Mani Sharma, learned counsel for the applicant and Sri Ajay Singh, learned A.G.A-I for the State are present. 3. This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant-Mohar Singh @ Mor Singh, seeking enlargement on bail during trial in connection with Case Crime No.182 of 2021, u/s 307, 302, 506, 120-B, 34 IPC, P.S. Cantt. District Bareilly. 4. This is the second bail application. The first bail application of the applicant was rejected by Hon'ble Siddharth, J., vide order dated 26.10.2023 passed in Criminal Misc. Bail Application No.5977 of 2022. The trial was expedited by the said order. 5. This matter has been nominated to this Court vide order dated 6.1.2025 of Hon'ble The Chief Justice. On 29.5.2025, learned counsel for the applicant submitted that as per his instructions, the trial is at final stage and thus direction was issued to the trial court to ensure that the matter is not adjourned unnecessarily and no casual adjournment be given to either of the parties. 6. The office through its office report dated 17.7.2025 has placed on record the report received from the trial court concerned. This Court has perused the said report dated 15.7.2025 of the Addl. Sessions Judge, Court No.1, Bareilly, duly forwarded by the District Judge, Bareilly on 16.7.2025. A perusal of the said report goes to show that the final arguments of the prosecution have concluded and the matter is at the stage of arguments of the side of accused and 16.7.2025 was fixed. It is further stated in para 6 of the said report that there are many lawyers representing the accused persons and short dates are being fixed in the matter. The said report further shows that there are six accused in the matter. 7. In view of the same, looking to the fact that trial is at an advance stage and is nearing completion, no good ground for bail is made out. The bail application is, accordingly, rejected. 8. However, the trial court is again reminded of the previous order directing it not to adjourn the matter casually and proceed with it diligently and expeditiously. 9. Registrar (Compliance) to communicate this order to the concerned trial court within a week. (Samit Gopal, J.)
