The petitioner has filed the present petition under Section 483 of B.N.S.S with a prayer to grant regular bail to him in case FIR No. 116, dated 12.06.2023, registered under Sections 302, 307,201,34 of IPC, Police Station Ajnala, District Amritsar Rural (Annexure P-1). 2. The FIR in the present case was registered on the basis of the statement made by Nishan Singh son of Bir Singh and the same has been reproduced below:- “Statement of Nishan Singh s/o Bir Singh r/o Village Deenewali PS Ajnala, Distt. Amritsar age about 33 years M.No.9855947067. It is stated that I am resident above said address and do labour job. We are five brothers and sisters. The eldest one is Balwinder Singh, younger to him is sister Balwinder Kaur then younger to her is myself and younger to me is Salwinder HITESH 2025.08.22 17:39 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-41944-2025 - 2- Kaur and the youngest is Baggi Kaur who was married with Gurdarshan Singh @ Manga son of Bawa Singh r/o village Mahmoodpur, Distt. Patiala about 4 years back. Her daughter is Jasmeet Kaur @ Suman who is about 3/4 years. My sister Baggi Kaur have started living separately from Gurdarshan Singh and is living with us from last one year along with her daughter Jasmeet Kaur @ Suman in village Deenewali and during this my sister Baggi Kaur developed relations with Raju Singh son of Karnail Singh r/o Chak Fakra and was residing with him alongwith his daughter as wife of Raju Singh in village Chakdogra from last 7 months. Today on 12.6.2023 in the morning Sikandar Singh son of Ajit Singh r/o Chakdogra who is grandson of my maternal uncle informed me on mobile that your sister Baggi Kaur and your niece Jasmeet Kaur @ Suman have been inflicted injuries in the night of 11.6.2023 at about 11.00 pm by Raju Singh with sharp edged weapon and the daughter Jasmeet Kaur @ Suman have died on the spot and her dead body have been concealed by Raju Singh and his mother Bholi and Baggi Kaur have been taken to Civil hospital Ajnala by Raju Singh as she had suffered serious injuries on the head. Then I and my brother Balwinder Singh immediately started for the house of Raju Singh in village Chakdogra and after reaching there found many people gathered over there and when we went inside and saw that the roof of the rooms and the courtyard was having the blood stained of human blood and the HITESH 2025.08.22 17:39 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-41944-2025 - 3- clothes were also blood stained. The Courtyard was washed with the water by Raju Singh and Bholi to clean up the blood stained. Earlier also Raju Singh used to beat my sister Baggi Kaur and earlier also she had informed us about that and whenever we used to make him understand he always said that she has brought the girl from the earlier house and he will kill the girl and Baggi Kaur. Raju Singh in connivance with his mother Bholi have given injury on the head of my sister Baggi Kaur and have killed my niece Jasmeet Kaur @ Suman with sharp edge weapon and have misappropriated the dead body by concealing it somewhere. You have come on the spot on the information given by us. I am complainant. Legal action be taken against Raju Singh son of Karnail Singh and his mother Bholi wife of Karnail Singh residents of Chak Dogra and justice be delivered to us. We have got recorded our statement, heard same is correct. Sd/ Nishan Singh”. 3. Learned counsel for the petitioner has vehemently argued that he has been falsely implicated in the present case as Baggi Kaur, sister of the complainant was having illicit relations with the petitioner and had started residing with him in his house, against the wish of her family members. Even otherwise, the petitioner was supporting Baggi Kaur and had no reason to cause injuries to the minor child. Even otherwise, the petitioner was arrested in the present case on 15.06.2023 and is in custody for the last 02 years and 02 months. 4. On the other hand, learned State counsel has vehemently opposed HITESH 2025.08.22 17:39 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh CRM-M-41944-2025 - 4- the prayer made by learned counsel for the petitioner on the ground that petitioner in connivance with Bholi, co-accused had committed the murder of minor girl namely Jasmeet Kaur @ Suman aged about 04 years. Even, he concealed the dead body of minor child, so as to save himself from the criminal prosecution. Learned State counsel further submits that the petitioner also caused grievous injuries on the head of Baggi Kaur, sister of the complainant with a spade with an intention to kill her. 5. I have heard the learned counsel for the parties and perused the record carefully. 6. In the present case, the complainant had levelled serious allegations against the present petitioner. In fact, he colluded with his co- accused namely Bholi had killed a minor girl namely Jasmeet Kaur @ Suman, aged about 04 years. Even, he gave a blow on the head of Baggi Kaur with a spade with an intention to kill her and the said injury has been declared to be grievous in nature. 7. Thus, keeping in view the gravity of the offence and nature of crime, the petitioner is not entitled to concession of bail by this Court in the present case. 8. Dismissed accordingly.
