1. Present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari seeking quashing of the order dated 07.07.2025 (Annexure P-2), vide which claim of the petitioner has been declined and further to issue a writ in the nature of mandamus directing the respondents not to reduce the pension and to release the arrears of revised pension along with interest @12% per annum.

CWP-22156-2025 (O&M) -2- submits that earlier petition filed by the petitioner i.e. CWP-6899-2024 was allowed along with a bunch of petitions, lead case of which is CWP-5378-2024 titled as Inderjit Singh Kaknian and others Vs. Union of India and others, decided on 12.09.2024. Thereafter, respondents No.2 & 3 filed an intra-Court appeal bearing LPA No.2747 of 2024, which is pending consideration for
11.12.2025. Further, claim of the petitioner with regard to enhanced pension has already been accepted in terms of the aforementioned judgment. The petitioner has filed the present petition praying for release of arrears of enhanced pension along with interest. The said claim of the petitioner would be decided after final disposal of aforesaid LPA No.2747 of 2024. As such, the present petition is barred by the principle of res judicata.
3. Faced with the above, learned counsel for the petitioner wishes to withdraw the present petition.
4. Dismissed as withdrawn.
5. Needless to say that claim of the petitioner with regard to arrears of higher pension and interest would be subject to final outcome of LPA-2747-
2024.
6. Pending miscellaneous application(s), if any, shall be disposed of.
