Apprehending their arrest in FIR No.51 dated 03.08.2021 registered for offences punishable under Sections 307, 325, 324, 323, 201, 34 of IPC at Police Station Khem Karan, District Tarn Taran; the petitioners have preferred this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail. 2. On 04.08.2025, the following order was passed: “Apprehending their arrest in FIR No.51 dated 03.08.2021 registered for offences punishable under Sections 307, 325, 324, 323, 201, 34 of IPC at Police Station Khem Karan, District Tarn Taran; the petitioners have preferred this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail. Counsel for the petitioners, inter alia, contends that the petitioners have been summoned by virtue of exercising the NAVEEN NAGPAL 2025.09.24 15:54 I attest to the accuracy and authenticity of this order/judgment HIgh Court Chandigarh CRM-M-41744-2025 P a g e | 2 power under Section 193 Cr.P.C. The petitioners have already approached this Court by way of CRR-279-2023 against the said summoning order, wherein the petitioners were extended the concession of personal exemption, the petitioners have been causing appearance before the concerned Court in accordance with law & the petitioners are willing to cooperate with the culmination of the trial. Notice of motion. On the strength of advance notice; Mr. Eklavya Darshi, DAG, Punjab accepts notice on behalf of the respondent No.1- State. At this stage; Mr. Ajaypal Singh Aulakh, Advocate has entered appearance on behalf of the respondent No.2 and filed his power of attorney. The petitioner is directed to appear before the concerned trial Court on or before 08.09.2025, the next date fixed before the trial Court, where they shall be admitted to interim bail by such Court. They shall abide by the condition(s) enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. List on 18.09.2025.” 3. It is not in dispute before this Court that the petitioners have caused appearance before the concerned Court on 05.09.2025, in terms of order dated 04.08.2025. 4. In view of the above as also in the totality of the factual milieu of the case in hand, the petition is allowed and the order dated 04.08.2025 granting anticipatory bail to the petitioners is hereby made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS. 5. This order should not be treated as “blanket” order. It will not be read granting petitioners indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioners violate any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause. 7.
