This writ petition has been filed by the alleged delinquent assailing the Departmental Proceeding initiated against her on the basis of the Memorandum of Charge dated 20/08/2024 by contending that there is no definite charge brought against the petitioner, as a result of which, she is unable to defend her interest. By order dated 07/03/2025, this Court had directed the learned Government Advocate, Assam, to obtain instruction. Today, when the matter is called up, Mr. J.K. Goswami, learned Additional Senior Government Advocate, Assam, has produced a copy of the communication dated 24/03/2025 issued by the Joint Secretary to the Government of Assam, Women & Child Development Department, to submit that definite charge will be framed against the writ petition within 3 (three) days from today by modifying the earlier show cause notice dated 20/08/2024. There is no wrangle at the Bar that such a recourse is permissible under the law. In view of the above, by retaining a copy of the communication dated 24/03/2025 in the record of this case, this writ petition stands disposed by granting liberty to the respondents to do the needful, in accordance with law.
