ORAL ORDER
This petition is filed by sole accused under Section 483 of BNSS praying to grant bail in Crime No.367/2025 of Challakere Police Station registered for offences

punishable under Sections 109, 118(1), 351(2) and 352 of BNS.
2. Heard the counsel for the petitioner and learned High Court Government Pleader for respondent No.1 – State. Inspite of service of notice, respondent No.2 remained absent and unrepresented.

Learned counsel for the petitioner would contend that the petitioner is father and injured is his son. The alleged incident has taken place at about 06.45p.m., on 07.08.2025 and as per discharge summary the injured has been admitted in the hospital at about 10.14p.m., on 08.08.2025, complaining of headache and decreased vision in the right eye since 2 days. The injured has been discharged from the hospital and there is no danger to his life. The petitioner is in custody since 08.08.2025. He is aged 70 years and he is suffering from age related ailments. The petitioner is not required for further custodial interrogation. The petitioner is ready to co- operate with the police in further investigation. If the

petitioner is granted bail, he will not stay with his son - injured and he will reside separately in the house of his daughter. With this, she prays to allow the petition and grant of bail to the petitioner –accused.

Per contra, learned High Court Government Pleader for respondent No.1 -State would contend that the wound certificate indicates that there is a right temporal fracture bone/skull and bone exposed and it is stated to be grievous injury. The investigation is in progress. If the petitioner is granted bail, he will again go to his house where in injured is residing and may commit similar offence. With this, she prayed to reject the petition.
5. Having heard learned counsels, this Court has perused FIR, complaint and other materials placed on record.
6. Averments of the first information indicate that there were quarrels between petitioner and his wife. The injured being his son has advised his father, due to which the alleged incident has taken place. The petitioner is in

judicial custody since 08.08.2025 and therefore, he is not required for further custodial interrogation. The petitioner is aged 70 years and he is stated to be suffering from age related ailments. The petitioner has undertaken that if he is granted bail, he will not reside with his son. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions.
7. In the result, the following
ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No. 367/2025 of Challakere Police Station subject to following conditions; a) The petitioner -accused shall execute a personal bond for sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of jurisdictional Court.

b) The petitioner -accused shall co-operate with the police in further investigation. c) The petitioner -accused shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case. d) The petitioner -accused shall not tamper the prosecution witnesses either directly or indirectly. e) The petitioner -accused shall not reside with the injured till disposal of the case registered against him.
