The captioned Writ Petition is filed seeking following reliefs: (a) A Writ of Certiorari or writ, order or direction of appropriate nature quashing the order dated:23.09.2011 passed in SL Application No.1/2010 on the file of the Industrial Tribunal, Mysore vide Annexure-G. (b) A Writ of Mandamus or any other writ, order or direction of appropriate nature granting such other reliefs that this Court deems fit, in the facts and circumstances of the case, including the cost of the proceedings, in the interest of justice. - 3 - HC-KAR NC: 2025:KHC:46974 WP No. 4619 of 2013 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care. 4. Suffice it to note that the petitioner came under a disciplinary inquiry proceedings for an act of misconduct and after holding a detailed inquiry he was dismissed from service. It is pivotal to note that the petitioner assailed the order of dismissal in I.D.A.No.07/2010 before the Labor Court and the Labor Court vide award dated:22.12.2011 dismissed the application. As against the dismissal of the application the petitioner had preferred a Writ Petition in No.40217/2012 and this Court by a detailed order has dismissed the Writ Petition i.e., confirmed the award of the Labor Court. It is noted that the Labor Court has allowed the application filed by the Management and the approval was accorded to the Management for dismissing the petitioner. The Labor Court is justified in according the approval. Furthermore, this Court has rejected main Writ Petition, hence, this petition is liable to be dismissed and accordingly it is dismissed. - 4 - HC-KAR NC: 2025:KHC:46974 WP No. 4619 of 2013 Because of dismissal of the Writ Petition, pending interlocutory applications if any are disposed of and interim direction if any stands discharged.
