ORAL ORDER
Heard the learned counsel for petitioner, learned Additional SPP for the State and perused the material on record. 2. This petition is preferred by accused No.4 in Crime No.358/2025 of Channagiri Police Station, Davanagere, to enlarge him on bail. 3. FIR is registered on a complaint lodged by one Mubeena Bhanu wife of Syed ghani sab, on the basis of which, aforementioned case is registered against accused Nos.1 to 6. 4. It is alleged that, on 19.06.2025, when first informant's son Syed Thanveer had been to the market to purchase areca nuts, one Mallik bin Shoukath Ali (Accused No.4) picked up quarrel with him. Thereafter, on 20.06.2025, at about 10:00 a.m., all the accused came near the Kirani shop, of her husband and abused him, accused No.1 assaulted him on his head and fingers

with a chopper. Further, when her children tried to rescue him, accused Nos.1, 4, 5 and 6 assaulted them with iron rod and repees patti all over the body and threatened with dire consequence etc. 5. The injured took treatment at Channagiri Government hospital and Mc.gann hospital, Shivamogga. As per wound certificate, injured by name Syed Thanveer has sustained grievous injuries and other three injured have sustained simple injuries. 6. A perusal of the complaint averments goes to show that initially accused No.1 picked up quarrel with first informant's son. It is alleged that thereafter, all the accused came near the Kirani shop of first informant's husband, abused and assaulted him etc. and when her children came to rescue their father, they were also assaulted by the accused. 7. It is contended by the learned counsel for the petitioner that on account of previous enmity, the entire

family members have been implicated in this case, including the petitioner, i.e., the father of accused No.1. 8. Petitioner was arrested on 20.06.2025. He is in judicial custody since then. Omnibus allegations are made that he along with other accused assaulted first informant's sons when they tried to rescue their father. Accused No.2 has been enlarged on bail by this Court in Crl.P.No.10651/2025.
All the injured are discharged from the hospital. In the facts and circumstances, further detention of the petitioner may not be required. Hence, the following:
ORDER
i) Petition is allowed. ii) Petitioner/accused No.4 in Crime No.358/2025 of Channagiri Police Station, pending on the file of the Principal civil Judge (Jr.Dn.) and JMFC, Channagiri, shall be enlarged on bail, subject to following conditions:

1. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall not indulge himself in committing any offence.
5. He shall appear before the trial Court regularly on all dates of hearing. Violation of any of the condition shall result in cancellation of bail.
