ARAVALA RAMA RAO(SC FOR APSRTC KKAC) The Court made the following Order: The Writ Petition is instituted seeking the following main prayer, which is extracted hereunder: “….to call for the records from the 2nd respondent and issue an appropriate Writ, Order or Direction, particularly one in the nature of Writ of Mandamus declaring that the proceedings No.DSP/E4/876(50)/08-RM/Kadapa dated 22- 11-2008 issued by the 2nd respondent, refusing to consider case of the petitioner for promotion to the post of Assistant Depot Clerk/Controller as illegal, unjust, contrary to law, arbitrary, discriminatory, amounts to an act of victimization and unfair labour practice and violative of Articles 14, 16 and 21 of the Constitution of India and grant all consequential benefits.” 2 MRK,J W.P.No.28315 of 2008 2. The conspectus of the main lis relating to the promotion of the petitioner to the post of Assistant Deport Clerk/Controller. 3. It is apt to note that on 12.12.2024 & 28.01.2025, there was no representation on behalf of the petitioner. Hence, the matter was posted to today under the caption “For Dismissal”. 4. Despite the fact that the matter is posted under the caption „For Dismissal‟, today also, there is no representation for the petitioner. 5. Sri B. Venkateswara Rao, learned counsel appearing on behalf of Sri Aravala Rama Rao, learned counsel appearing for the 2nd respondent is present. 6. It is apt to mention that, respondents Nos.1 & 2 - A.P.S.R.T.C. filed a counter-affidavit, dated 09.08.2010, wherein paragraph-6 specifically stated that, the Departmental Selection Committee, on 30.08.2009, selected the petitioner to the post of Assistant Deport Clerk and posted at Rajampet, Kadapa District. For the sake of comprehensive view, paragraph-6 of the counter-affidavit extracted hereunder, which reads as follows: “6. It is submitted that the Writ Petitioner filed W.P.No.20596 of 2008 before this Hon’ble Court seeking promotion to the position of ADC. This Hon’ble Court in W.P.M.P. No.26895 of 2008 granted interim orders to consider the case of the Writ Petitioner to the post of ADC. Proceedings dated 22.11.2008 were issued to the Writ Petitioner communicating the reasons for his non selection to the post of ADC by the Departmental Committee which met on 06.12.2007 and 14-08-2008. Subsequently, the Departmental Selection Committee which met on 30-08-2009 3 MRK,J W.P.No.28315 of 2008 selected the Writ Petitioner to the post of ADC and posted to Rajampet. At present he is working as ADC at Rajampet Depot. Therefore, the petitioner’s case was considered for promotion to the post of ADC as per his eligibility.” 7. Thus, in view of subsequent events taken place, more so, by taking into consideration the averments made in the affidavit and also the relief which the petitioner seeking selection to the post of Assistant Deport Clerk is already fulfilled, this Court deems it appropriate to close the present Writ Petition as no further orders are necessary. 8. Accordingly, this Writ Petition is closed. There shall be no order as to costs.
