Learned counsel for the applicant-petitioner points out that the primary prayer in CWP-PIL-164-2025 was against the encroachment being made by the sitting Sarpanch and other persons, which has not been referred to in the order under review, and therefore a palpable error has occurred. The contentions of learned counsel for applicant-petitioner may be true to a certain extent but considering the fact that complaints/representations both dated 10.09.2024, (Annexures P-6 and P-7), which we have directed to be decided by the concerned authorities vide the order under review contain the said grievance of encroachment as well as request for removal of Sarpanch and therefore we do not find that there is any error apparent on the face of the record. 5.
