It is the grievance of the petitioner that under the pretext of enquiry, the respondent Police are unnecessarily harassing the petitioner and insisting for the return of jewels without repayment of the amount to be paid for the redemption of jewels. 3. The learned Government Advocate (Criminal Side), on instructions, submitted that on the complaint given by the de facto complaint, the investigation is going on. 4. In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and co- operate with the investigation.
