The order dated 19.07.2025 passed by the respondent No.2/Sub Divisional Magistrate, Machhali Shahar, District Jaunpur is under challenge. 2. Today when the matter is taken up, a preliminary objection has been raised by learned Standing Counsel that against the order impugned, the petitioner has an alternative remedy to file appeal before the Commissioner of the Division as provided under Section 13(3) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 3. At this stage, a prayer has been made by learned counsel for the petitioner to dismiss the present petition as withdrawn with liberty to avail the statutory remedy of appeal before the appellate authority. 4. This prayer has not been opposed by learned Standing Counsel. 5. Accordingly, the present petition is dismissed as withdrawn with liberty as prayed.
