HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 2074 OF 2025 ORDER: As per the directions of My Lord the Hon'ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025. 2. This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioner seeking to release him on bail in the event of arrest in crime No. 401 of 2024 of Parawada Police Station, Anakapalli District, registered for the offences punishable under Sections 111 (2) (b), 196 and 353 (2) read with Section 61 (2) of Bharatiya Nyaya Sanhita and Section 67 of Information Technology Act. 3. Heard Sri J.Sudharshan Reddy, learned counsel appearing for the petitioner, and learned Additional Public Prosecutor appearing for the respondent-State. 4. Case of the prosecution is that de facto complainant is working as President of Parawada Mandal Telugu Desam Party for the past 15 years. It is alleged that while de facto complainant 2 was browsing facebook on his mobile phone, he has come across two fake postings; one against Tirumala Tirupati Devastanam and the other against Education Minister of the State. The said two postings are in the nature of defaming the images of Tirumala Tirupati Devastanam and the Education Minister of the State. On the basis of the said postings, de facto complainant gave a report to police. 5. Learned counsel appearing for the petitioner contends that the petitioner is not responsible for posting the above fake postings in facebook and that similar crimes have been registered against the petitioner previously and he has been arrested and subsequently released on bail. Learned counsel therefore requests this Court to grant anticipatory bail to the petitioner. 6. Having perused the entire material on record, it is not there in the report that the petitioner has posted the above fake postings in facebook. Be that as it may, as the petitioner has already been arrested in similar crimes previously and also released on bail, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 3 7. The petitioner is, therefore, directed to surrender before the Station House Officer, Parawada Police Station, Anakapalli District, on or before 25-04-2025. On such surrender, the petitioner is ordered to be enlarged on bail on his executing a personal bond for Rs.25,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, Parawada Police Station. After release, the petitioner is directed to report before the Station House Officer, Parawada Police Station, once in a week i.e. on every Saturday between 10 a.m. and 1 p.m. until further orders. 8.
