ORAL ORDER
Petitioner is the sole accused facing trial in SC.No.5032/2024 pending before the learned IV Additional District and Sessions Judge, Tumakuru sitting at Madhugiri.
2. The above case arise out of Cr.No.60/2024 of Pavagada police station, registered for the offence punishable under Section 302 of IPC.
3. It is the case of prosecution that the petitioner has committed the murder of his wife - Ramanjanamma, on 15.03.2024 at about 11.30 a.m., stabbing on her neck, chest and other parts of the body with a knife after picking up quarrel with her for not giving money.

4. The prosecution case is mainly based on the statements of the eyewitnesses CWs.2 to 5. While disposing of Crl.P.No.10741/2024 preferred by the petitioner, this Court, permitted the petitioner to file a fresh petition after examination of CWs.1 to 5.
5. It is submitted that CWs.1 to 5 are examined before the Trial Court and they have completely turned hostile to the prosecution case. The copies of the depositions of the said witnesses are furnished along with the petition.
6. Petitioner is in judicial custody from
15.03.2024. The material witnesses are already examined. Though, their evidence cannot be appreciated in this petition, however, considering that the eye-witnesses cited by the prosecution are already examined and the petitioner is in judicial custody for nearly 1 ½ years, the relief sought can be granted by imposing suitable conditions. Hence, the following:

ORDER
Petition is allowed.
Petitioner / sole accused in S.C.No.5032/2024 pending before the learned IV Additional District and Sessions Judge, Tumakuru sitting at Madhugiri (Crime No.60/2024 of Pavagada Police Station, Tumkur District) shall be released on bail subject to following conditions: a) Petitioner shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh Only) with two sureties for likesum to the satisfaction of the jurisdictional Court; b) He shall not indulge himself in committing any offence. c) He shall not leave the jurisdiction of trial Court without prior permission of the learned Sessions Judge. d) He shall not tamper with the prosecution witnesses either directly or indirectly. e) He shall appear before the trial Court on all dates of hearing without fail.

If any of the conditions are violated, the prosecution is at liberty to seek cancellation of bail.
