This Civil Petition is filed under Section 24 of Code of Civil Procedure with the following prayer: "(a) Allow this petition and grant an order of transfer the petition in M.C.71/2024 from Principal Judge, Family Court, Kodagu-Madikeri, to the Court of Principal Civil Judge and JMFC at Channarayapatna, in the interest of justice and equity. (b) Grant such other further relief deemed filed in the circumstances of the case in the interest of justice and equity." - 3 - HC-KAR NC: 2025:KHC:50828 CP No. 280 of 2024 3. Facts in brief which are utmost necessary for disposal of the present petition are as under: 3.1 On account of strained relationship between the parties, there were number of matrimonial proceedings between the parties. In the present petition, the wife wants the transfer of the matrimonial case in M.C.No.71/2024 from Court at Madikeri to Court at Channarayapatna on the ground that the petitioner is unable to visit Madikeri on every date of hearing on account of geographical distance and on financial incapacity and a minor daughter is studying in Channarayapatna. 4. The grounds of transfer is opposed by Sri Srinivas V., the learned counsel for respondent. 5. Having noted that geographical distance and financial incapacity are no longer valid parameters for transfer of a pending case from one Court to another Court in view of the video conference facility, petition needs to be dismissed. 6. If the petitioner files an application before the Court at Madikeri seeking permission to appear through video - 4 - HC-KAR NC: 2025:KHC:50828 CP No. 280 of 2024 conference, such an application shall be allowed by the Court at Madikeri and permit the petitioner to appear through video conferencing and effectively participate in the pending matrimonial case. 7.
