ORAL ORDER
1. Petitioners are seeking to quash the F.I.R in Crime No.52/2024 of North Women Police Station, Bengaluru City, registered against them for offences punishable under Section 498A, 504, 506 r/w Section 34 of IPC and Section 3 and 4 of the Dowry Prohibition Act, 1961. 2. Respondent No.2 is the defacto complainant. She has filed an affidavit in support of I.A.No.1/2025 seeking permission of the Court to compound the offence. The affidavit reads as under;
"1. I state that I am the De-facto Complainant i.e. the Respondent No.2, I know the facts of the case and I am competent to swear on this affidavit. 2. I state that I had filed a complaint before the Complainant Police and accordingly the Complainant Police filed an FIR bearing No. 0052/2024 against my husband and my inlaws. 3. I state that in due course there was a case filed before the Hon'ble Vth Addl. Family Court Judge, Bengaluru in G and W.C No. 220/2024, wherein the my Husband i.e., the Petitioner No.1 herein had sought for custody of our Children. 4. I state that the aforementioned case was referred to mediation and upon mediation it was agreed upon to bury our differences and reunite as husband and wife and seek to lead a happy life together and

accordingly I have been living with the Petitioners herein happily without any differences between us. 5. I state that an mediation agreement was drawn upon, wherein I have also undertaken to withdraw all my cases which includes the case pending Hon'ble 34th ACJM, Bengaluru in CC No. 3915/2024 pending before it and I seek not to further 315 precipitate further on it as I seek to lead a happy life with the Petitioners with love and affection from all. Fufthermore, the mediation agreement was put up before the Hon'ble Family Court Judge, who upon considering the same has accepted-the Memorandum of Settlement dated:28/08/2025 and the same is herein produced as Annexure No.1 and 2 for the kind perusal of this Hon'ble its order Court. 6.
I state that I entered in to the agreement without pressing any allegations against the Petitioners without any pressure or coercion by any one in order to enter into the agreement and accordingly in lieu of the same I seek to withdraw the present case pending against my husband and my inlaws. 7. I state that I have reconciled with the Petitioner No.1 and am living happily with the my family. 8. I thereby pray that this Hon'ble Court be pleased to allow me application and quash the C.C No. 3915/2024 pending before the Hon'ble 34th ACJM, Bengaluru and allow the present petition."
3. It is submitted that while filing charge sheet, names of petitioners No.2 to 4 are dropped and the charge sheet is filed only against petitioner No.1. Case is pending before the XXXI A.C.J.M, Bengaluru in C.C.No.39715/2024. - 5 -

4. The matter arises out of a matrimonial dispute, wherein the parties have arrived at an amicable settlement. The petitioner and respondent No.2 have re- united. It is stated in the affidavit that they are living together and leading a happy life. 5. Petitioner No.1 and respondent No.2 are present before the Court. Respondent No.2 submits that in view of the settlement, she is not interested to proceed with the case any further and she has no objection to quash the proceedings. 6. In the light of the above, no useful purpose would be served in keeping the matter pending before the Trial Court. In order to secure the ends of justice, it is expedient to quash the proceedings. Accordingly, the following;
ORDER
(i) The petition is allowed.

(ii) The entire proceedings arising out of Crime No.52/2024 of North Women Police Station, Bengaluru City pending on the file of XXXI A.C.J.M, Bengaluru in C.C.No.39715/2024 are quashed. I.A.No.1/2025 is allowed.
