! This is an application under Section 11 (6)(a) of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as, ‘the 1996 Act’). 2. Vide order dated May 29, 2026 a Coordinate Bench of this Court directed that the respondent would be proceeded against ex parte since despite service through publication no one represented the respondent. 3. Learned counsel appearing on behalf of the petitioner submits that Share Subscription and Shareholding agreement was entered into between the parties on July 15, 2020. Clause 5.6 of the said agreement contained an arbitration clause for the adjudication of disputes and differences arising between the parties by way of arbitration. 4. Since the disputes and differences arose between the parties, notice dated June 11, 2025 was issued under Section 21 of the
1996. However, there is no response to the said notice. 5. Therefore, the instant application under Section 11 of the 1996 Act has been filed. Despite service of notice, today also the respondent remains unrepresented. 6. Accordingly, Mr. K.S. Garewal, Resident of H.No.1065/1, Sector 39B, Chandigarh.160036 (Mobile No.9876002909) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties, subject to compliance of the statutory requirements. 7. Liberty is granted to the parties to raise all claims, counter claims, defences, pleas etc. before the Learned Arbitrator. 8. Needless to mention that all the questions arising between the parties shall remain open for determination in the arbitral proceedings and any observation made hereinabove will not be binding on the learned Arbitrator. 9. As per Clause 5.6 (Annexure P-2), the venue of arbitration was fixed at Gurugram. Parties are free to make request to the learned Arbitrator to fix the ‘Venue’ at Gurugram. All the necessary expenses of the learned Arbitrator will be equally shared by the parties. 10. A request letter along with a copy of this order be sent to Mr. K.S. Garewal, Resident of H.No.1065/1, Sector 39B, Chandigarh.160036 (Mobile No.9876002909). 11. With the directions aforesaid ARB-764-2025 is disposed of.
