.......... Opp. Parties. -----
CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Prabhat Kumar Sinha, Advocate For the State : Mr. Ankit Kumar, AC to SC-I -----
Order No.03
Date: 18.07.2025
1. The present contempt case has been filed for initiating contempt proceeding against the opposite party no.2 for her wilful and deliberate violation of the order dated 14th October, 2024 passed in W.P.(C) No.3543 of 2024.
2. Mr. Ankit Kumar, learned A.C. to S.C.I, refers to the reasoned
order as contained in letter no.242 dated 21st May, 2025 annexed with the show cause affidavit filed on behalf of the opposite party no.2 (wrongly mentioned as opposite party no.4) and submits that by the said order, the admitted amount of the petitioner’s claim has been paid. It is, thus, submitted that the aforesaid order of this Court has been complied by the opposite party no.2.
3. Since the admitted amount of petitioner’s claim has already been paid by the opposite party no.2 to the petitioner, I see no reason to further proceed in the matter. The contempt proceeding as against the said opposite party is hereby dropped.
4. The present contempt case stands disposed of.
2025:JHHC:19658
5. The petitioner is, however, at liberty to take appropriate recourse against non-payment of balance amount of his claim as mentioned in the letter dated 21st May, 2025.
