Heard learned counsel Mr. N.Mahajan for petitioner Jakir Hussain who has filed this application under Section 482 of the BNSS, 2023 with a prayer for pre- Page No.# 2/2 arrest bail as he is apprehending arrest in connection with Nilambazar PS Case No. 24/2025 under Section 316(5)/318(4) of the BNS, 2023. 2. Mr. D.P.Goswami, learned Addl.Public Prosecutor is present for the respondent State. 3. The allegation against the petitioner is that he has received work order for construction works and after completion of construction, it has been unearthed that the petitioner has withdrawn excess to the sanctioned funds. The petitioner is on interim bail vide order dated 04.03.2025 granted by a co-ordinate Bench of this Court. 4. I have scrutinized the Case Diary. 5. Case Diary reveals that the petitioner has appeared before the I.O. and his statement has been recorded. He has not violated the bail conditions.
