The Petitioners are before this Court seeking for the following reliefs: a. To nominate and appoint Sri. A.K. Narayan as Sole Arbitrator and/or in the alternate treat him as Nominee of the Petitioners and to Nominate and Appoint Respondent/s Nominee Arbitrator in terms of Clause 29 of the Joint Development Agreement, dated 03.04.2019 (Annexure-A) for resolution of disputes between the petitioners and the Respondent ; and b. To grant such other relief/s as this Hon’ble Court may deem fit in the circumstances of the case, including the costs of this petition, in the interest of justice. 2. After arguing for sometime, both the counsel submit that former District Judge of the District Judiciary to be appointed as a sole arbitrator to arbitrate the dispute between the parties by leaving all the contentions open. 3. Chandramalle Gowda, a former District Judge of the District Judiciary of the State of Karnataka is appointed as sole arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court. iii) Registry is directed to forward a copy of this order to the Director, Arbitration and Conciliation Centre for doing the needful. iv) Since the order is passed in the presence of all the counsel, they shall appear before the Director, Arbitration and Conciliation Centre without requirement of any notice on 27.11.2025 at 2.30 p.m. v) All contentions are left open. - 5 - HC-KAR NC: 2025:KHC:45632 CMP No. 532 of 2024 vi) Registry is directed to return the original and/or certified copies, if produced, to the respective parties who have produced it/them by following due procedure.
