1. Heard Sri Vishal Tandon, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The writ petition is being heard finally without inviting counter affidavit with the consent of learned counsel for the parties. 3. Brief facts of the case are that the petitioner was granted a license for Fair Price Shop about several years back. On the basis of some complaint, proceedings were initiated against the petitioner and report dated 29.03.2025 was submitted. In pursuance of the aforesaid inquiry report, a show cause notice dated 29.03.2025 was isued to the petitioner. The petitioner filed his detailed reply to the aforesaid show cause notice on 15.04.2025. Thereafter, another complaint was filed and on the same, again inquiry was conducted on 25.04.2025. Again a show cause notice dated 30.05.2025 was issued to the petitioner and the petitioner again submitted a detailed reply on 17.06.2025. Thereafter the respondent No.2 passed the order of suspension on 25.07.2025 Hence the present petition with the following prayers:- i. To call for the records and issue a writ, order or direction in the nature of certiorari, quashing the order dated 25.07.2025 passed by the Respondent no. 2 i.e. Sub Divisional Officer, Tehsil-Najibabad, District-Bijnor whereby his fair price shop agreement has been suspended. ii. To issue a writ, order or direction in the nature of mandamus commanding the Respondent authorities to restore the fair price agreement of the petitioner for Gram Panchayat-Budgara, Block-Kiratpur, Tehsil-Najibabad, District-Bijnor. iii. To issue any other writ order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. 4. Learned counsel for the petitioner submitted that petitioner was granted the licence for fair price shop about several years back and the petitioner was distributing the Essential Commodities to the card holders without any complaint of anybody. He submitted that with a malafide intention the instant proceeding has been initiated and under the impugned order the fair price shop licence of the
petitioner has been suspended in arbitrary manner.
He further placed the government order dated 05.08.2019, which is annexed as Annexure No.6 along with the writ petition in order to demonstrate that suspension order should not have been passed in a routine manner. He next submitted that even after submission of the inquiry report dated 10.05.2024 supply was given to the petitioner upto June 2024 and the petitioner has distributed the essential commodities to card holders, as such there was no occasion to pass the suspension order in respect to the fair price shop licence of the petitioner, accordingly the impugned suspension order dated 28.06.2024 is liable to be set aside. He further submitted that report of the observer has not been taken into consideration while passing the suspension orders. 5. On the other hand, Sri Pradeep Singh, learned Standing Counsel on the basis of the instructions submitted that the report of the observer, can not be taken into
consideration as she was not posted at that time in the concern area. He submitted that against observer, the proceeding has been initiated, which is pending before the Authority, as such no reliance can be placed upon the report of observer. He next submitted that irregularities have been found against the petitioner in respect to the distribution of Essential Commodities to the card holders, as such no interference is required against the suspension order passed by the Authority. He submitted that against the suspension order dated 28.06.2024 appeal will lie under Section 13 of the U.P. Essential Commodities (Regulation of Sale and Distribution Control)
order, 2016, as such the writ petition is liable to be dismissed on the ground of alternative remedy. 6. I have considered the arguments advanced by the learned counsel for the parties and perused the record. 7. There is no dispute about the fact that petitioner was granted fair price shop licence about thirty five years back. There is also no dispute about the fact that under the impugned order the fair price shop license of the petitioner has been suspended. 8.
In order to appreciate the controversy involved in the matter, perusal of the relevant portion of the Government Order dated 05.08.2019 will be necessary, which is as under:- ससंख्यय-4/2019/1206/29-6-2019-300 सय/03 टटीसटी पप्रेषक, ओम पकयश वमयर, ववशप्रेष सवचिव, उत्तर पदप्रेश शयसन। सप्रेवय मम, 1- आययक, खयद्य एवसं रसद ववभयग, उ०प०। 2- समस्त जजिलयजधिकयरटी, उत्तर पदप्रेश। 3- समस्त जजिलय पपूवतर अजधिकयरटी, उत्तर पदप्रेश। खयद्य एवसं रसद अनयभयग-6 लखनऊऊः वदनयसंक 05 अगस्त, 2019 ववषयऊः गयमटीण एवसं शहरटी कप्रेत्र ककी उवचित दर ककी दयकयननों कप्रे वनलम्बन /वनरस्तटीकरण एवसं सम्बदटीकरण कप्रे सम्बन्धि मम पवक्रियय कय वनधियररण। महहोदय, उपययरक ववषयक लवकत सयवरजिवनक ववतरण पणयलटी कप्रे अन्तगरत कययररत उवचित दर दयकयननों कप्रे ववरूद पयप्त वशकययतनों ककी जियसंचि एवसं तत्क्रिम मम उनकप्रे ववरुद ससंपयवदत ककी जियनप्रे वयलटी कययरवयवहयनों यथय वनलम्बन, वनरस्तटीकरण एवसं सम्बदटीकरण कप्रे सम्बन्धि मम समय-समय पर वववभन्न शयसनयदप्रेशनों कप्रे मयध्यम सप्रे वनदरश पसयररत वकयप्रे गयप्रे हह। वतरमयन मम लयगपू रयषषटीय खयद्य सयरकय अजधिवनयम - 2013 एवसं तत्क्रिम मम जियरटी उत्तर पदप्रेश आवश्यक वस्तय (ववक्रिय एवसं ववतरण वनयसंत्रण कय वववनयमन) आदप्रेश-2016 तथय उत्तर पदप्रेश खयद्य सयरकय वनयमयवलटी-2015 कप्रे पख्ययपन तथय लयभयजथरयनों कहो आवश्यक वस्तयओसं कप्रे ववतरण मम तकनटीककी अनयपयहोग (पबबलक पहोटरल पर सम्बद लयभयजथरयनों कय ऑनलयइन पदशरन एवसं तद्नयसयर आवसंटन कय ससृजिन तथय ई०पटी०ओ०एस० मशटीननों कप्रे मयध्यम सप्रे करययप्रे जिय रहप्रे ववतरण ) तथय डहोर स्टप्रेप वडलटीवरटी कय कययर पचिजलत हहोनप्रे कप्रे दृवषगत पपूवर मम वनगरत समस्त शयसनयदप्रेशनों कहो अवक्रिवमत करतप्रे हहयप्रे वतरमयन पररदृश्य मम वनम्नवत व्यवस्थय वनवदरष वकयप्रे जियनप्रे कय मयझप्रे वनदप्रेश हहआ हह:- 1- उवचित दर दयकयननों कप्रे ववरूद पयप्त वशकययतनों ककी जियसंचि- (1) उवचित दर ववक्रिप्रे तयओसं कप्रे ववरूद सयमयन्यतयय आवश्यक वस्तयएएँ पयप्त न हहोनप्रे , ववक्रिप्रे तय दयरय घटततौलटी वकयप्रे जियनप्रे , अजधिक मपूल्य जलयप्रे जियनप्रे, एवसं सपूचिटी मम नयम न हहोनप्रे कय बहयनय बनयकर खयद्ययन्न न दप्रेनप्रे, ई-पपॉस मशटीन मम नप्रेटवकर न आनप्रे सवरर डयउन हहोनप्रे कय बहयनय बनयकर खयद्ययन्न ववतरण कप्रे पपूवर हटी बययहोमप्रेवटषक पमयणटीकरण करयकर लयभयजथरयनों कहो वयस्तव मम खयद्ययन्न न दप्रेकर कयलयबयजियरटी कर लप्रेनप्रे तथय यपूवनट कप्रे सयपप्रेक कम खयद्ययन्न दप्रेनप्रे , कयडर मम दजिर यपूवनटनों कप्रे सयपप्रेक कम यपूवनट कप्रे आधियर फकीड हहोनप्रे कय आधियर लप्रेकर शप्रेष यपूवनटनों कय खयद्ययन्न न दप्रेनप्रे , उपभहोकयओसं सप्रे दयव्यरवहयर करनप्रे, समय सप्रे दयकयन न खहोलनप्रे, आवश्यक सपूचिनयओसं कय पदशरन न करनप्रे, आवद वशकययतम पयप्त हहोतटी हह। वशकययत मयख्यतऊः मय० मयख्यमसंत्रटी हप्रेल्प लयइन, ववभयगटीय टहोल फकी नम्बर कपॉल सप्रेन्टर, आई०जिटी०आर०एस०, तहसटील वदवस, उप जजिलयजधिकयरटी, जजिलय पपूवतर अजधिकयरटी, जजिलयजधिकयरटी, मण्डलयययक, खयद्ययययक एवसं शयसन पर जलजखत मम डयक दयरय, व्यवकगत रूप सप्रे एवसं दपूरभयष
पर पयप्त हहोतटी हह। वशकययतकतयर मयख्यतऊः तटीन पकयर कप्रे हहो सकतप्रे हह , यथय वववशष व्यवक, सम्बबन्धित उवचित दर ववक्रिप्रे तय सप्रे सम्बद कयडरधियरक एवसं सम्बबन्धित उवचित दर ववक्रिप्रे तय सप्रे सम्बद लयभयजथरयनों सप्रे वभन्न अन्य शहोत/व्यवकयनों कप्रे स्तर सप्रे पयप्त वशकययतम। (2) उपरहोकयनयसयर पयप्त हहोनप्रे वयलटी वशकययतनों पर कययरवयहटी जियएँचि कप्रे सम्बन्धि मम वनम्नवत पवक्रियय अपनययटी जिययप्रे- (क) वववशष व्यवकयनों सप्रे पयप्त वशकययतटी पत्रनों कप्रे सम्बन्धि मम कययरवयहटी आरम्भ करनप्रे सप्रे पपूवर सम्बबन्धित वववशष व्यवक कहो पत्र भप्रेजिकर यह पयवष कर लटी जियय वक पत्र उन्हहीं कप्रे दयरय हस्तयकररत हह और वशकययतनों कप्रे सम्बन्धि मम उनकहो समयधियन हहो गयय वक वशकययतम तथ्यनों पर आधियररत हह। (ख) सम्बबन्धित उवचित दर ववक्रिप्रे तय सप्रे सम्बद कयडरधियरकनों कप्रे स्तर सप्रे पयप्त वशकययतनों पर कययरवयहटी सप्रे पपूवर वशकययतनों ककी पयरबम्भक जियएँचि ककी जियए। उवचित दर दयकयननों कप्रे ववरूद जियएँचि पवक्रियय कप्रे दतौरयन ववक्रिप्रे तय दयरय ई-पपॉस कप्रे मयध्यम सप्रे वकयप्रे गयप्रे ववतरण कय वववरण (एम०आई०एस० ररपहोटर) जिहो पबबलक पहोटरल पर उपलबधि हह, कय ससंजयन अवश्य जलयय जियय। ववक्रिप्रे तय दयरय पदवशरत ववतरण कय वमलयन कयडरधियरकनों कप्रे रयशन कयडर मम दयकयनदयरनों दयरय ककी गयटी पवववषयनों सप्रे भटी वकयय जिय सकतय हह। सयथ हटी वशकययतकतयर व अन्य सम्बबन्धित पकनों कय कथन असंवकत करतप्रे समय उनकय पवतपरटीकण भटी अवश्य वकयय जिययप्रे तयवक जियएँचि कययरवयहटी ककी वनष्पकतय पथम दृषयय स्थयवपत हहो एवसं अनयवश्यक जलवटगप्रेशन ककी बस्थवत उत्पन्न न हहो। (ग) अन्य सहोतनों/व्यवकयनों सप्रे पयप्त वशकययतनों कप्रे सम्बन्धि मम यवद वशकययतटी पत्र शपथ पत्र सप्रे समजथरत नहहीं हह , तहो वशकययतकतयर सप्रे इस बयरप्रे मम एक शपथ पत्र उपलबधि करयनप्रे कहो कहय जियए और शपथ पत्र पयप्त हहोनप्रे कप्रे उपरयन्त हटी आगप्रे ककी कययरवयहटी ककी जियए। (घ) उवचित दर ववक्रिप्रे तय कप्रे ववरूद वकसटी एक यय अत्यन्त अल्प ससंख्यय मम उपभहोकयओसं दयरय उवचित दर ववक्रिप्रे तय ककी दयकयन पर जियनप्रे कप्रे बयवजिपूद अपनय अनयमन्य खयद्ययन्न पयप्त न हहोनप्रे ककी बस्थवत मम वप्रे अपनटी वशकययत जजिलय वशकययत वनवयरण अजधिकयरटी कप्रे समक भटी दजिर करय सकतप्रे हह, जिहो वनधियरररत पवक्रियय
कय पयलन करतप्रे हहए पकरण कप्रे परटीकणहोपरयन्त उसककी वनयमयनयसयर हकदयरटी /खयद्य सयरकय भत्तय वदलययय जियनय सयवनबश्चित करमगप्रे।" 2- उवचित दर दयकयननों कप्रे ववरुद कययरवयहटी- (1) जजिलय पपूवतर अजधिकयरटी कहो सम्पपूणर जजिलप्रे कप्रे (जजिसमम नगरटीय एवसं गयमटीण दहोनहो कप्रेत्र सबम्मजलत हनोंगप्रे) लवकत जिन ववतरण पणयलटी कप्रे सभटी दयकयननों कप्रे वनरटीकण तथय उनकप्रे ववरूद दण्डयत्मक कययरवयहटी (वनलम्बन/वनरस्तटीकरण आवद) करनप्रे कय अजधिकयर हहोगय। गयमटीण कप्रेत्र मम उपजजिलयजधिकयरटी अपनप्रे तहसटील अन्तगरत सभटी दयकयननों कय वनरटीकण तहो कर सकम गप्रे , वकन्तय ववक्रिप्रे तयओसं कप्रे ववरूद दण्डयत्मक (वनलम्बन/वनरस्तटीकरण एवसं बहयलटी) कययरवयहटी हप्रेतय अपनटी आख्यय जजिलयजधिकयरटी कहो पप्रेवषत करमगप्रे। जजिलयजधिकयरटी दयरय आवश्यकतयनयसयर सम्बबन्धित पकरण मम जजिलय पपूवतर अजधिकयरटी सप्रे ववभयगटीय अवभमत पयप्त वकयय जिययप्रेगय। जजिलयजधिकयरटी कय जलजखत आदप्रेश पयप्त हहोनप्रे कप्रे उपरयन्त उप जजिलयजधिकयरटी दयरय ववक्रिप्रे तयओसं कप्रे ववरूद दण्डयत्मक (वनलम्बन/वनरस्तटीकरण एवसं बहयलटी ) ककी कययरवयहटी करतप्रे हहए, पश्नगत दयकयन ककी बस्थवत कप्रे सम्बन्धि मम ऑनलयइन पवववष असंवकत ककी जिययप्रेगटी। उप जजिलयजधिकयरटी दयरय पकरण मम कसृ त कययरवयहटी ककी एक पवत जजिलय पपूवतर कयययरलय कहो अवनवययर ततौर पर उपलबधि करययटी जिययप्रेगटी, तयवक उवचित दर ववक्रिप्रे तयओसं कप्रे कययररत हहोनप्रे ककी बस्थवत कहो अद्यतन वकयय जिय सकप्रे । (2) उवचित दर दयकयननों कय अनयबन्धि पत्र वनलबम्बत हहोनप्रे कप्रे पश्चियत कयडरधियरकनों कहो खयद्ययन्न उपलबधि करययप्रे जियनप्रे कप्रे जलए दयकयननों कय सम्बदटीकरण वनलम्बन कप्रे सयथ हटी वकयय जियतय हह और उवचित दर दयकयन कप्रे कयडरधियरकनों कहो वकसटी अन्य उवचित दर दयकयन सप्रे सम्बद वकयय जियतय हह। उक दयकयन दपूर हहोनप्रे कप्रे कयरण कयडरधियरकनों कहो असयववधिय कय सयमनय करनय पडतय हह। इस बस्थवत सप्रे बचिनप्रे कप्रे जलए वकसटी भटी ववक्रिप्रे तय कप्रे ववरूद वनलम्बन ककी कययरवयहटी तभटी ककी जियय , जिब वनरस्तटीकरण कप्रे पययरप्त आधियर हनों। कयडरधियरकनों सप्रे वभन्न व्यवक ककी वशकययत पर अथवय रयजिनहवतक आपसटी ववदप्रेष कप्रे कयरण सरसरटी ततौर पर वनलम्बन ककी कययरवयहटी कहो कई पकरणनों मम मय० न्ययययलय दयरय उवचित नहहीं मयनय हह। अतऊः जिहयएँ तत्कयल वनलम्बन ककी कययरवयहटी वकयय जियनय अपररहययर हहो, उसटी बस्थवत मम वनलम्बन ककी कययरवयहटी ककी जियय। 9.
Perusal of the Government Order dated 05.08.2019 demonstrates that license for fair price shop should not be suspended in a routine manner rather the same should be in the case of extreme urgency. The record demonstrates that proceeding was initiated on 29.03.2025 and petitioner was given supply of essential commodities even upto 25.07.2025, as such in place of suspension of the fair price shop license, the inquiry has to be concluded in proper manner. 10. So far as alternative remedy is concern, the same will not be absolute bar to entertain the writ petition under Article 226 of the Constitution of India as inquiry is still to be concluded by the authorities in accordance-with law. 11. Considering the entire facts and circumstances of the case, the impugned suspension order 25.07.2025 passed by the respondent no. 2-Sub-Divisional Officer is hereby set-aside. 12. The writ petition stands allowed and the respondent no. 2-Sub-Divisional Officer is directed to conclude the pending inquiry proceedings against the petitioner after affording proper opportunity of hearing expeditiously, preferably within a period of three months from the date of production of a certified copy of this order. Respondent no. 2 is directed to restore the supply of Essential Commodities to the petitioner forthwith.
