1. Mr. Saurabh Kumar Pandey, learned counsel for the applicant.
2. Mr. V.S. Pal, learned A.G.A. for the State.
3. The instant bail application, moved on behalf of the applicant-Chaman Singh, is listed at serial no. 42 and Mr. Saurabh Kumar Pandey, learned counsel make urgent mention by informing that the father of the applicant died today early in the morning and the schedule time for cremation is about 3:00 pm.
4. The present applicant is an accused for the offence punishable under sections 8/22 of the NDPS Act, arising out of FIR dated 19.05.2025 bearing FIR No. 217 of 2025 registered at P.S. Jaspur District U.S. Nagar.
5. Mr. Pal, learned A.G.A. was directed to get instruction whether father of the applicant died or not. On telephonic instructions he apprised this Court that the father of the applicant died today early in the morning.
6. Mr. Saurabh Pandey,
learned counsel for the applicant submits that the instant bail application be converted into short term bail application and the applicant be granted short term bail on the ground that the father of the applicant died today.
7. Mr. Pal, learned A.G.A. has no objection to this.
8. Accordingly, the instant bail application is converted into short term bail application.
9. Taking into consideration that the father of the applicant died today early in
2025:UHC:6699 the morning and the schedule time for cremation is about 3:00 pm, therefore, this Court is of the view that the applicant deserves for short term bail.
10. Accordingly, the short term bail application is allowed.
11. Let the applicant Chaman Singh be released on short term bail forthwith for a period of six weeks, to be reckoned from the date of his release, on his executing a personal bond to the satisfaction of the court concerned. It is made clear that after being released on bail the applicant shall furnish two reliable sureties of the like amount to the satisfaction of the court concerned within a week.
12. Needless to say, on completion of six weeks, to be reckoned from the date of release, the applicant shall surrender before the court concerned.
