Learned Counsel for the parties are present.
3. Pursuant to order dated 09.07.2025, Mr. Pitambar Jena, learned Counsel for the OFDC (Opposite Party No.2) submits that as per the instruction received, the submission made by the learned Counsel for the Petitioner on 9th July, 2025 is correct.
4. Mr. Jena learned Counsel for the Corporation submits, he has no objection if the writ petition stands
disposed of in terms of common
Judgment dated 22.11.2024 passed in W.P.(C) No.21388 of 2016 and W.P.(C) No.5597 of 2016.
5. Mr. Khuntia, learned Counsel for the Petitioner hands up a website copy of the Judgment passed in W.P.(C) No.21388 of 2016 and W.P.(C) No.5597 of 2016 (Sudam Charan Nayak Vrs. State of Odisha & others) so also
the office order dated 25th February, 2025 in proof of implementation of the said judgment, which are taken on record. Mr. Khuntia, learned Counsel for the Petitioner submits, Office Order dated 25th February, 2025 pertains to a person, who is junior to the Petitioner.
6. Accordingly, the writ petition stands disposed of with an observation that Petitioner’s case for regularization shall be considered by the Opposite Party-Corporation subject to availability of vacancies, as held in Sudam Charan Nayak (supra).
7. It is made clear that the case of the Petitioner for regularization shall be considered in terms of the judgment in Sudam Charan Nayak (supra), keeping in mind the case of juniors, if any, has been regularized in the meantime.
