JUSTICE MRIDUL KUMAR KALITA ORDER 21.04.2025 1. Heard Ms. A. Das, the learned counsel for the applicants. Also heard Ms. S. Todi, the learned counsel for the respondent. 2. This application under Order XXII Rule 3(1) of the Code of Civil Procedure, 1908 has been preferred by the applicants for substitution of the legal representatives of the deceased appellant Rama Ranjan Chanda, who had expired on 07.04.2016. 3. It is pertinent to mention herein that in a connected interlocutory application, namely, (I.A. (Civil) No. 985/2025), the application for condoning the delay in preferring the instant application has already been allowed and the delay has been condoned. 4. The learned counsel for the respondent has not objected to the Page No.# 4/4 prayer for substituting the legal representatives of the deceased appellant Rama Ranjan Chanda. 5. In view of the submissions of the learned counsel for the parties as well as the reasons mentioned in the instant petition, the legal heirs of the deceased appellant, namely, (i) Smti. Rita Rani Chanda, (ii) Sri Subodh Chanda, (iii) Smti. Sumita Chanda, (iv) Sri Sujit Chanda and (v) Smti. Namita Sarkar are allowed to be substituted as appellant No. 1(i) to 1(v) in place of the deceased appellant. 6. The learned counsel for the applicants shall file the amended cause title in the connected regular second appeal No. 255/2010 and thereafter, the Registry shall list the connected regular second appeal.
