HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 28825 of 2025 Court No. - 5 HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri D.S. Patel, learned counsel for applicant and Sri B.P. Singh, learned AGA for State at length.
2. At this stage, argument of learned counsel for applicant (father in law of deceased) that testimonies of 2 children of deceased has diluted the case against applicant to the extent that prosecution may fail to prove the case beyond reasonable doubt has no basis since both witnesses have been cross-examined at length, therefore, to read a small part of it, ignoring the other lengthy cross-examination would not be appropriate at the stage of consideration of bail.
3. Accordingly, this Court does not find any ground to consider present bail application, hence, it is rejected.
4. However, a liberty is given to applicant to approach this Court after a reasonable period of 8 months along with status report if the trial is not substantially progressed or concluded.
