Learned counsel for the petitioner submits that the petitioner is claiming the same benefit as extended by the Coordinate Bench of this Court in the bunch of petitions being CWP-5382-2023 titled as Baljinder Singh and others vs. State of Punjab and others decided on 04.08.2023 (Annexure P/7) along with other connected cases as well as subsequently in CWP-26478-2023 titled as Malkit Singh and others vs. State of Punjab and another decided on 08.04.2024 (Annexure P/8) along with other connected cases but the petitioner is not being granted the said benefit despite the fact that the similarly situated employees have already been granted the said benefit by the respondents.

Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the legal notice dated 11.08.2024 (Annexure P-9), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued AARTI SHARMA 2025.08.02 12:59 I attest to the accuracy and integrity of this document

order in a time bound manner.

4. On the asking of the Court, Mr. T.P.S. Chawla, Senior Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the respondent-State and submits that in case, legal notice dated 11.08.2024 (Annexure P-9) has been received by the respondents and the same is still pending consideration with the authorities concerned, the same will be decided by the respondents by passing an appropriate speaking order within a period of eight weeks from the date of the receipt of copy of this
order. In case, it is found feasible to accept the claim of the petitioner, the same will be accepted, otherwise due reasons for not accepting the claim of the petitioner will be mentioned in the speaking order so passed which order will be conveyed to the petitioner for his information and necessary action.

Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondents, the present petition may kindly be disposed of having been not pressed any further.
