The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 3.7.2025 registered as Case Crime No. 227 of 2025, under sections-115(2),352,351(2) B.N.S. and Section 3(2)(va) of SC/ST Act Police Station- Sihani Gate, District- Ghaziabad and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report. Learned AGA and learned counsel for the opposite party no.4 inform that charge sheet has already been submitted on 8.8.2025, but it is not clear whether cognizance has been taken by the court below or not. The writ petition is disposed of till cognizance is taken by court on police report submitted under Section 173(2) Cr.P.C.,/193(3) B.N.S.S., the respondents are restrained from arresting the petitioners pursuant to the First Information Report, subject to cooperation in ongoing investigation.
