Apprehending their arrest, the petitioners, namely, (i) Smti Swagata Hazarika, daughter of Sri Narendra Nath Hazarika and (ii) Sri Debasish Hazarika, son of Sri Narendra Nath Hazarika, both residents of Subash Colony, Ajanta Neog Path, Police Station-Golaghat, District- Golaghat have filed this application under Section 482 BNSS, 2023, praying for their pre-arrest bail in Nagaon Police Station Case No. 26/2025 registered under Sections 316(2)/318(4)/340(2) of the BNS, 2023. 3. The allegation against the petitioners is that petitioner no.1 Smti Swagata Hazarika has taken money from the informant’s son. It is also alleged that the petitioner no.2 has been involved with this offence. The petitioner no.1 Smti Swagata Hazarika had induced the informant to invest money in share market and assured to pay monthly profit of Rs. 1,25,000/-. Finally the informant invested an amount of Rs. 8,35,000/-. 4. The petitioner no.1’s brother i.e., Sri Debasish Hazarika was also deeply involved in these fraudulent activities. 5. I have scrutinized the case-diary. The co-ordinate Bench of this Court has granted interim bail vide order dated 06.03.2025. The petitioners have appeared before the I.O. and they have co-operated with the investigation. Their statements have also been recorded. They have not violated any bail conditions. Page No.# 3/3 6.
