The instant application has been preferred by the petitioner praying for a direction upon the 5th Respondent to consider and pass an appropriate order to approve the proposal communicated by the respondent no.3 and 4 vide letter dated 14.05.2022 and 4.04.2024 to the 5th Respondent recommending the name of the petitioner for his promotion to the post of Reader/Associate Professor under the relevant statutory provisions on completion of Ten years of regular substantive service. Learned counsel further prayed for release of the arrears of salary and other consequential benefits arising out of the aforesaid promotion. 2. Learned counsel for the petitioner submits that till date no any decision has been taken by the concerned authority. 3. Learned counsel for the respondent- Commission submits that since the proposal was sent by the University which was having some discrepancy; as such, a letter has already been sent to the University to send the recommendation afresh after curing the discrepancy. 4. Having regard to the aforesaid facts and circumstances of the case, since the matter is pending before the concerned respondents with regard to claim of the petitioner for promotion to the post of Reader/Associate Professor, the instant writ application, is hereby, disposed of by directing the Respondent-University to resend the 2025:JHHC:12563 3 recommendation after curing the discrepancy as pointed out by the Respondent-Commission within a period of ten weeks from the date of receipt of a copy of this order. Subsequently, the Respondent Commission shall look into the matter and pass an appropriate order and send back to the University within a further period of ten weeks and thereafter, necessary order for all consequential benefits shall be passed by the State Government within a further period of six weeks. 5. Accordingly, the instant writ application stands disposed of in the manner indicated hereinabove. Pending I.A.s if any, also closed. (Deepak Roshan, J.) Fahim/-
