JUSTICE SUMAN SHYAM ORDER Date : 19-03-2025 Heard Mr. A. Ahmed, learned counsel for the writ petitioner. Also heard Ms. R. Devi, learned CGC appearing for the respondent No. 1. In terms of the order dated 07-03-2025 passed by this Court Mr. A. Atreya, learned counsel has appeared today on behalf of NEEPCO authorities. The core issue involved in this writ petition is pertaining to the transfer order dated 21-02-2025 by means of which, the petitioner, who is presently posted at Assam Gas Based Power Station, NEEPCO Ltd, Bokuloni, Dibrugarh, was transferred to Doyang Hydro Electric Power Station in Nagaland. Taking note of the nature of grievance expressed by the petitioner, this Court had fixed the matter today so as to enable the NEEPCO authorities to respond to the primary grievance of the petitioner that since his daughter is in mid-academic session, he should not be disturbed from his present place of posting atleast till 31-03-2025. Mr. Atreya submits, on instruction, that the NEEPCO authorities have agreed to allow him to continue in the present place of posting till 31-03-2025. If that be so, one of the grievances of the petitioner to allow him to stay at the present place till 31-03-2025 stands resolved. Insofar as the other prayer for cancellation/ modification of the transfer order is concerned, having regard to the grounds urged in this petition, this Court is not inclined to make any observation in that regard. Inconvenience of an employee may be a good ground for the authorities to look into the matter but the same cannot be the sole ground Page No.# 3/3 for the court to interfere with a transfer order. Therefore, by granting liberty to the petitioner to submit a fresh representation, ventilating his grievance before the authorities, this writ petition stands closed. If such a representation is submitted by the petitioner, it will be open for the authorities to look into it objectively and pass any order that may be deemed fit and proper, in the facts and circumstances of the case.
