Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the Petitioner herein/A4, seeking anticipatory bail, in connection With Crime No.337 of 2024 of Eluru Ill Town Police Station, Eluru district. 2. A case has been registered against the Petitioner herein and others for the offences punishable under Sections 308(5), 318(4) and 351 (2) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, iS that in the year 2022, the de facfo complainant married Al as his second Wife. Since then, Al allegedly deceived him With false Promises, Claiming tO be an lps officer in the NIA and falsely stated that multiple cyber cases had been registered against him, including allegations of phone hacking. She insisted that all these Cases could only be resolved by paying off the relevant officials. On that pretext, she took gold and cash from the de facfo complainant in instalments. By trusting her, the de faCfo complainant gave money whenever she asked, using his savings and bank loans. ln addition, along with his relative, A2 \- r\-
\ 2 Jrty is alleged to have threatened and I-ntiml'dated the de facfo complainant, fraudulently taking 44 sovereigns of gold ornaments and approxl'mately Rs.79.00 Lakhs of cash from him. 4. Heard. perusedtherecord. 5. A perusal of the material on record goes to show thatthe only accusation that has been made against the petitioner herein is that she shared the sI'gned blank cheques extorted from the de raofo complainant among her accomplI'CeS and the same was seized from the possession ofAl by the police. Except the saI'd accusation, prJ-ma fao,'e, there I'S nO Other material to connect the petitioner herein to the alleged crime. Further, basing on the confessional statement of co-accused, the petl-tjoner herein has been arraigned as accused in the present crI'me. PetI-tiOner herein is a lady aged about 60 years. 6. ln view of the aforesaid facts and circumstances of the case, this court I-`s¢ inclined to grant antjcjpatory ba" to the Petitioner herein/A4 on the followl'ng condI'tiOnS. i) In the event of arrest of the petitioner herein/A4 in the aforesaid crime, she sha" be enlarged on ba" on her executI-ng a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand *s-l `9 .#
only) with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer.
ii) petitioner shall make herself available for interrogation by a poll'ce officer as and when required, and she shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the,.case so as to \ dissuade him from disclosing such facts to the Court or to any police officer. iii) petit{ioner shall appear before the Station House Officer concerned, Once in a Week i.e., On every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7. Accordingly, the Criminal Petition is allowed. As a sequel thereto, the miscellaneous petitions, I'f any, pending in this Criminal Petition shall stand closed.
