This Application has been filed by the applicant- Saransh Dogra seeking anticipatory bail in NCB Crime No.III/NCB/DDN/Seize/01/2025, registered at NCB, Sub Zone, Dehradun under Section 8 read with Section 22(c) and Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short, “Act, 1985”). 2. As per the Remand Application of the respondent, 429 Capsules of Dicylomine Hydrochloride Tramadol Hydrochloride & Acetaminohphen Capsules, 40 Tablets of Alprazolam Tablets IP 0.50 mg and 165 Tablets of Actaminophen & Tramadol HCL Tablets were recovered on 12.05.2025 from one Neeraj Kumar Sharma. At the time of the said recovery, he told that the seized drugs were 1 2025:UHC:6065 provided to him by two persons, namely Saransh (applicant) and Gulfam. 3. Heard Mr. Pawan Mishra, learned counsel for the applicant and Mr. Shobhit Saharia, learned counsel for the respondent-NCB. 4. Mr. Shobhit Saharia, Advocate appearing for the respondent submitted that no other evidence has been found against the applicant so far. The investigation is at preliminary stage. 5. Mr. Pawan Mishra, Advocate submitted that the applicant is an innocent person. The statements of Neeraj Kumar Sharma were recorded under Section 67 of the Act, 1985. He mentioned the name of the present applicant before the NCB Team, but the statements recorded under Section 67 of the Act, 1985 cannot be read against the applicant. He further submitted that the applicant undertakes to appear before the NCB, in case notice under Section 67 of the Act, 1985 is issued on the address of the applicant as given in the present application. 6. Having heard. On the request of Mr. Pawan Mishra, Advocate, the present Anticipatory Bail Application (ABA No.751 of 2025) is disposed of accordingly. ___________________ ALOK KUMAR VERMA, J.
