This transfer petition (civil) has been filed for transfer of Original Suit No. 103 of 2025 from the Court of learned Additional Principal Judge-II, Family Court, Dhanbad to the court of learned Principal Judge, Family Court, Deoghar. 3. Learned counsel for the petitioner submits that the petitioner has already filed a complaint case vide Complaint Case No. 1895 of 2024 and a maintenance case vide Misc. (Maintenance) Case No. 195 of 2024, which is pending in the District Court, Banka, Bihar. It is submitted that since the Deoghar District is nearest to the Banka, therefore, Original Suit No. 103 of 2025 may be transferred from learned Additional Principal Judge-II, Family Court, Dhanbad to the court of learned Principal Judge, Family Court, Deoghar. 4. On the other hand, learned counsel for the opposite party has submitted that this is inter-State dispute and there is no case pending on behalf of wife at Deoghar, therefore, this petition is fit to be dismissed. 2025:JHHC:18652 2 5. It appears that in view of the facts, as set up by the petitioner, the proper remedy is to file application before the Hon’ble Apex Court. 6. Accordingly, the present transfer petition is dismissed.
